These Terms and Conditions govern your use of the JuryTest Networks Inc. site. Please read these terms and conditions carefully before using this site. If you use this site (whether passively reviewing its content, or actively participating in votes, message boards, or other content), you indicate your acceptance of these terms and conditions. If you do not agree to these terms and conditions, please do not use this site. These Terms and Conditions are subject to change without prior notice, and your continued use of this site constitutes acceptance of any changes to these terms and conditions. Accordingly, please check back periodically for any changes. The same applies with respect to the use of JuryTest Networks Inc.'s Privacy Policy, and with respect to any changes in the Privacy Policy. As a lawyer or litigation manager utilizing JuryTest Networks, you agree to hold harmless JuryTest Networks Incorporated for any results of using the service. You and/or your client assume the risk of any and all eventualities, including disclosures of confidential information, divergence between service feedback and litigation results, including verdict and/or damages. I understand that the feedback I receive is a function, at least in part, of the nature of the information I present, including arguments, evidence and exhibits. Trademarks and Copyrights The materials on this site provided by JuryTest Networks Inc. (including written content, images, audio and video clips, and code and software), are owned by JuryTest Networks Inc. and are protected by international copyright and trademark laws. You may not use, reproduce, publish, transmit, publicly perform or display, translate, create derivative works from, or otherwise communicate to the public the content thereof, in whole or in part, any material from this site, except that you may make one copy, for your personal, non-commercial use only, provided that all copyright and other notices are left intact. Any other use of this material (including any modification of this material) is prohibited. The marks, "JuryTest.net," "jurytest.net," "JuryTest Networks," "JuryTest Networks Incorporated," "Jurytest Networks Incorporated,""JuryTest.com" and "jurytest.com" are trademarks and a service mark of JuryTest Networks Inc. (registration pending), and may not be used without permission. By submitting any content to the JuryTest Networks site, including by voting on cases, posting messages, participating in studies or other surveys, inputting or uploading data or engaging in any other form of communication (any such content submitted by a user being a "Member Submission"), you are granting to JuryTest Networks Inc. and its affiliates a royalty-free, perpetual, irrevocable, unrestricted, non-exclusive right and license to use, reproduce, publish, transmit, publicly perform, or display, translate, create derivative works from, or otherwise communicate to the public the content thereof, in whole or in part, on a world-wide basis, including the right to incorporate it in other works in any form or media whatsoever. You also grant to JuryTest Networks Inc. the right to sublicense any such Member Submission to third parties, and to otherwise exploit any proprietary rights in such communication, including copyright, trade and service mark, and patent laws. JuryTest Networks Inc. is not responsible for the content of any Member Submission. If you believe that any Member Submission or other JuryTest Networks Inc. content violates a copyright that you own, please follow the Notice and Procedure for Making Claims of Copyright Infringement. Privacy JuryTest Networks Inc. is dedicated to protecting the privacy rights of its users. Please review the Privacy Policy for the details of JuryTest Networks Inc.'s Privacy Policy. User Conduct JuryTest Networks Inc. does not control the information submitted by users of the site, nor does it undertake to monitor or review such Member Submissions. JuryTest Networks Inc. is not responsible in any manner for Member Submissions, and any opinions, advice, statements, or other information submitted by users is the sole responsibility of the submitting user. You will be solely responsible for the content of your Member Submissions, and you agree to indemnify and hold harmless JuryTest Networks Inc. and its affiliates and agents against any claim or damages arising from your Member Submissions. JuryTest Networks Inc. welcomes and indeed is designed to foster spirited debate and thoughtful input on various cases and issues. By using this site, you agree to provide true, accurate, current, and complete information. In addition, please always be courteous and respectful, even when in disagreement with a position or argument. Challenges must be restricted to other points of view and opinions; personal attacks and insults are not allowed. Please do not use profanity, vulgarity, threatening, offensive or hateful speech; do not harass or inflame other users. Do not post commercial messages or solicitations, including links to other internet sites. Do not post duplicate messages or post personal information about yourself, but also do not misrepresent yourself by impersonating another person or entity. The use of JuryTest Networks Inc. for illegal activity, or advocating illegal activity, is strictly prohibited. JuryTest Networks Inc. does not monitor or review Member Submissions. JuryTest Networks Inc. does, however, have the right to delete or modify Member Submissions (without notice) that violate these Terms and Conditions or are otherwise considered objectionable by JuryTest Networks Inc. in its sole discretion. If you believe that a Member Submission warrants removal for this reason, please notify us at admin@JuryTest Networks Inc. JuryTest Networks Inc. does not have any obligation, however, to review Member Submissions, or to delete or modify Member Submissions, even after being notified of a potential violation. Outside Links; Third Party Purchases JuryTest Networks Inc. is not responsible for the content of any sites that may be linked to the JuryTest Networks Inc. site, and use of these linked sites is at your sole risk. These other sites may have privacy policies that are different from the JuryTest Networks Inc. privacy policy. From time to time, JuryTest Networks Inc. may provide links to or furnish information concerning offers made by third parties for the sale of goods or services. All matters concerning any such purchase (including the accuracy of the product description, payment and delivery terms, warranties, etc.) are strictly between you and the third party. JuryTest Networks Inc. is not a party to any such transaction, and makes no representations or warranties concerning the product or services offered, even if JuryTest Networks Inc. receives some form of payment in connection with the transaction. Registration and Password JuryTest Networks Inc. may require users, clients, and/or subscribers to use a password for certain studies or services. In such case, you will be responsible for maintaining the confidentiality of your user name and password. You will be responsible for all uses of your account, whether or not authorized by you. You should immediately notify JuryTest Networks Inc. of any unauthorized use of your member name or password. Termination of Service/Membership JuryTest Networks Inc. reserves the right to deny you access to the site at any time and for any reason, including if JuryTest Networks Inc. in its sole discretion believes that you have violated these Terms and Conditions or otherwise engaged in unacceptable conduct. JuryTest Networks Inc. reserves the right to change, suspend or discontinue all or any aspect of its site at any time, including the availability of any feature, database or content, without prior notice. BY USING THIS SITE, YOU AGREE THAT USERS OF THIS SITE ARE SOLEY RESPONSIBLE FOR THEIR CONDUCT (INCLUDING THROUGH THEIR MEMBER SUBMISSIONS), AND THAT JURYTEST NETWORKS INC. MAKES NO REPRESENTATIONS WITH RESPECT TO THE INFORMATION CONTAINED ON THE SITE, INCLUDING BUT NOT LIMITED TO ITS ACCURACY, COMPLETENESS, TIMELINESS, RELIABILITY, OR RELEVANCY IN A PARTICULAR JURISDICTION. Limitation of Liability NEITHER JURYTEST NETWORKS INC. NOR ITS AFFILIATES OR AGENTS WILL BE RESPONSIBLE FOR OR HAVE ANY LIABILITY FOR ANY LOSS, DAMAGE (INCLUDING BUT NOT LIMITED TO, ACTUAL, CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES), INJURY, OR OTHER CLAIM RELATING TO YOUR USE OF THIS SITE, ANY INFORMATION POSTED ON THIS SITE (INCLUDING THE RESULTS FROM THE STUDEIS ON THE SITE) WHETHER PROVIDED BY JURYTEST NETWORKS INC. OR A MEMBER SUBMISSION, YOUR INABILITY TO ACCESS THIS SITE (OR THE NON-FUNCTIONING OF THIS SITE), OR FOR ANY REASON WHATSOEVER, INCLUDING TO THE EXTENT RESULTING FROM THE NEGLIGENCE OF JURYTEST NETWORKS INC., ITS AFFILIATES OR AGENTS, EVEN IF JURYTEST NETWORKS INC. HAS BEEN APPRISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY IN RESPECT TO YOUR USE OF THE JURYTEST NETWORKS INC. SITE AND ANY INFORMATION OR RESULTS CONTAINED ON THE SITE SHALL BE TO DISCONTINUE USING JURYTEST NETWORKS INC. Indemnification You agree to indemnify and hold JuryTest Networks Inc., its affiliates and agents, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of JuryTest Networks Inc. (including the information or results presented by JuryTest Networks Inc.), the violation of these Terms and Conditions by you, or any other user of your account, or the infringement by you, or by any other user of your account, of any intellectual property or other right of any person or entity. Miscellaneous These Terms and Conditions constitute the agreement between you and JuryTest Networks Inc. for your use of the JuryTest Networks Inc. site and the information on the JuryTest Networks Inc. site (the "Agreement"). This Agreement is governed by and construed in accordance with the internal laws of the Commonwealth of Massachusetts, and any action brought in connection with this Agreement shall be brought in the state or federal courts sitting in the Commonwealth of Massachusetts, unless JuryTest Networks Inc. shall in its sole option elect to bring an action elsewhere. You hereby submit to the jurisdiction of such courts for the purposes of any claim brought in connection herewith. This Agreement contains the entire agreement between you and JuryTest Networks Inc. If any provision of this Agreement shall be unlawful, void, or unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions, and this Agreement shall be construed so as to give effect to the fullest extent possible to the stricken provision. These Terms and Conditions shall survive any termination of your membership account, if any.
